Terms of Service

By accessing our website, purchasing a service, or entering into a project with Elewares, you agree to these Terms of Service. If a separate written agreement applies to your engagement, that agreement will control where it conflicts with these terms.

Elewares provides software design, development, consulting, and related digital services. The specific scope, deliverables, milestones, assumptions, and fees for a project will be described in the applicable proposal, order, or statement of work. Changes outside the agreed scope may require revised timing and fees.

Fees are due according to the terms shown at checkout or in the applicable project agreement. You are responsible for accurate billing information and applicable taxes. Unless otherwise stated in writing, amounts paid for completed work or committed project capacity are non-refundable. Recurring services may be cancelled before the next billing period.

You agree to provide timely access, content, approvals, and information reasonably required to perform the services. You represent that materials supplied to Elewares may lawfully be used for the project and do not infringe third-party rights. Delays in feedback or required materials may affect delivery dates.

You may not use our website, services, or deliverables to violate law, infringe intellectual property, distribute malicious code, compromise systems, misrepresent identity, harass others, or facilitate fraudulent or abusive activity. We may suspend services where necessary to protect users, systems, or third parties.

Elewares retains ownership of its pre-existing tools, frameworks, methods, know-how, and reusable components. Upon full payment, you receive the rights to project-specific deliverables described in the applicable agreement. Third-party software and assets remain subject to their respective licenses.

Each party will use reasonable care to protect confidential information received from the other and will use it only for the project or as required by law. Information that is public, independently developed, or lawfully received from another source is not considered confidential.

Services are provided with reasonable professional care. Except as expressly stated in writing, the website and services are provided “as is” without implied warranties. To the fullest extent permitted by law, Elewares will not be liable for indirect, incidental, special, consequential, or lost-profit damages. Our aggregate liability will not exceed the fees paid for the services giving rise to the claim.

Either party may terminate an engagement as permitted by the applicable project agreement. Provisions concerning payment, intellectual property, confidentiality, disclaimers, and liability survive termination. We may update these terms periodically; the date above reflects the latest revision.
